Federal Court throws out Gov. Cuomo Covid-19 restrictions.

On Monday, a New York federal appeals court ruled against Gov. Cuomo Covid-19 restrictions that were put in place “to stop the spread.”

The court prevented Gov. Cuomo’s enforcement of the orders that would put limitations on religious gatherings. The areas that were going to be affected by the executive order, which were considered “hot spots,” had been limited to 10-25% capacity depending on how the infection rate was.

Businesses in the “red zone” were required to reduce it’s workforce by 100%; if they were considered nonessential. All restaurants were required to do take-out and delivery only. The executive order also limited houses of worship to 10 people or 25%.

The plaintiffs argued that Governor’s restrictions were infringing the first amendment- The Free Exercise Clause.

They also agreed that the order in place wasn’t fair to religious groups and place way more restrictions on religious gatherings than secular ones.

Religious groups such as the Roman Catholics Diocese of Brooklyn and Agudath Israel of America are the ones who bought the lawsuit forward.
